These Terms of Service (the "Terms") define the rules for using the website available at collabay.com (the "Site") and the conditions for the provision of services by electronic means through the Site.
The Site is operated by the operator of the Collabay project, established in Poland (the "Operator"). Contact with the Operator is possible at the following email address: contact@collabay.com.
These Terms constitute the regulations for the provision of services by electronic means within the meaning of Article 8 of the Polish Act of 18 July 2002 on Providing Services by Electronic Means (Journal of Laws of 2002, No. 144, item 1204, as amended).
By using the Site, the User confirms that they have read these Terms and accept their content.
2. Definitions
Site — the website available at collabay.com, together with its subpages.
Operator — the entity operating the Site, as indicated in Section 1(2).
User — any natural person, legal person, or organisational unit using the Site.
Services — the services provided by the Operator by electronic means through the Site, specified in Section 3.
Waitlist — the service consisting of registering the User's email address for the purpose of receiving information about the availability of the Product.
Product — the Collabay software for board game publishers, currently under development and not commercially available.
3. Scope of Services
The Operator provides the following Services through the Site, free of charge:
access to informational content concerning the Product;
the Waitlist;
the contact form.
The Product presented on the Site is under development. All information published on the Site concerning the Product's features, availability, timelines, or pricing is of an informational nature only, does not constitute an offer within the meaning of Article 66 of the Polish Civil Code, and may be subject to change.
The Operator reserves the right to modify, suspend, or discontinue any element of the Site at any time.
4. Technical Requirements
Use of the Site requires:
a device with access to the internet;
a current version of a standard web browser with JavaScript enabled;
an active email account, where the User wishes to use the Waitlist or the contact form.
The Operator undertakes reasonable efforts to ensure the continuous availability of the Site but does not guarantee its uninterrupted operation.
5. Waitlist
Subscription to the Waitlist is voluntary and free of charge.
Subscription requires providing a valid email address through the form available on the Site. Upon submission of the form, an agreement for the provision of the Waitlist service by electronic means is concluded for an indefinite period.
The User may terminate the Waitlist service at any time, with immediate effect, by using the unsubscribe mechanism included in correspondence from the Operator or by submitting a request to contact@collabay.com.
Subscription to the Waitlist does not create any obligation on the part of the User and does not constitute a guarantee of access to the Product, access on any particular terms, or access within any particular timeframe.
6. Rules of Use
The User is obliged to use the Site in a manner consistent with applicable law, the provisions of these Terms, and good practice.
The User is prohibited from providing content of an unlawful nature.
In particular, the User shall not:
take actions aimed at obtaining unauthorised access to the Site or its underlying systems;
interfere with the operation of the Site, including by introducing malicious software or generating excessive load;
provide false information or personal data of third parties without authorisation;
copy, reproduce, or otherwise exploit the content of the Site beyond the scope of permitted personal use, without the Operator's prior written consent.
7. Intellectual Property
All content published on the Site, including the Collabay name and logotype, texts, graphic elements, product visualisations, and the layout of the Site, is protected under the Polish Act of 4 February 1994 on Copyright and Related Rights and other applicable provisions.
The product visualisations and the example game presented on the Site ("River Traders") are illustrative.
Use of the Site's content beyond the scope of permitted personal use requires the prior written consent of the Operator.
8. Complaints Procedure
Complaints concerning the functioning of the Site or the Services may be submitted to the following email address: contact@collabay.com.
A complaint should include a description of the issue and the contact details of the person submitting it, to the extent necessary to respond.
The Operator shall respond to a complaint within 14 days of its receipt, to the email address from which the complaint was submitted, unless the complainant indicates otherwise.
9. Liability
To the fullest extent permitted by applicable law, the Operator shall not be liable for damage resulting from interruptions in the availability of the Site, in particular where caused by force majeure, failures of telecommunications infrastructure, or actions of third parties.
The Operator shall not be liable for the consequences of the User providing false or incomplete data.
Nothing in these Terms excludes or limits any rights of consumers arising from mandatory provisions of Polish or European Union law, nor the Operator's liability for damage caused intentionally.
10. Personal Data
Personal data is processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR) and applicable Polish law.
11. Amendments to the Terms
The Operator reserves the right to amend these Terms, in particular in the event of changes in applicable law, changes in the scope of the Services, or organisational changes concerning the Operator.
The current version of the Terms is published on the Site, together with its effective date.
Amendments to the Terms enter into force upon publication on the Site. Continued use of the Site following publication constitutes acceptance of the amended Terms. Users subscribed to the Waitlist will, where feasible, be notified of material amendments by email.
12. Final Provisions
Should any provision of these Terms be found invalid or unenforceable, the remaining provisions shall remain in full force and effect.
In matters not regulated by these Terms, the applicable provisions of Polish law shall apply, in particular the Civil Code, the Act on Providing Services by Electronic Means, and the GDPR.
These Terms enter into force on the effective date indicated above.
